The ICADR and NALSAR University of Law, Hyderabad have planned to bring out the second issue of the Journal titled ‘NALSAR ADR Review’ in July, 2015.
In the recent years, a number of Judgments have been rendered by the Supreme Court of India which have created an arbitration friendly atmosphere and ensured an environment that is conducive to arbitration proceedings in India.
The arbitration law in India has undergone a drastic change after the landmark Judgment of the Supreme Court of India in Bharat Aluminium Co v. Kaiser Aluminium Technical Services Inc. (2012) 9 SCC 552.
The case stated that Part-I of the Arbitration and Conciliation Act, 1996 applies to arbitrations (domestic as well as international) that have their juridical or legal seat within the territory of India and not to those arbitrations where the seat of arbitration is outside India.
It is worthwhile to note the pro-arbitration approach adopted by the Indian Judiciary from the judgments rendered in the following cases:
(1) Sumitomo Heavy Industries v. Oil & Natural Gas Commission of India, (2010) 11 SCC 296
(2) Dozco India P. Ltd. v. Doosan Infracore Ltd., (2011) 6 SCC 179
(3) Denel(Proprietary Limited) v. Bharat Electronics Ltd., (2012) 2 SCC 759
(4) Shri Lal Mahal v. Progetto Gano SPA, (2014) 2 SCC 433
(5) Enercon(India) Ltd. & Ors. v. Enercon Gmbh and Anr., (2014) 5 SCC 1
(6) World Sport Group(Mauritius) Ltd. v. MSM Satellite(Singapore) Pte. Ltd.,
2014(1) Arb. LR 197 (SC)
(7) N. Radhakrishnan v. Maestro Engineers & Ors., (2010) 1 SCC 72
(8) Reliance Industries and Anr. v. Union of India, (2014) 7 SCC 603
